Il en existe <span style=\"text-decoration: underline;\"><strong>22 au total en France<\/strong><\/span> <em>(y compris celles cr\u00e9\u00e9es par la loi AGEC de 2020)<\/em>.&nbsp;<\/p>\n<p>Les \u00e9co-organismes ont <strong>plusieurs moyens pour parvenir \u00e0 leur objectifs<\/strong> :<\/p>\n<ul>\n<li><strong>Ramasser, collecter<\/strong><\/li>\n<li><strong>Transporter<\/strong><\/li>\n<li><strong>Trier<\/strong><\/li>\n<li><strong>Traiter<\/strong><\/li>\n<\/ul>\n<p>Il existe diff\u00e9rents type d\u2019organisation des fili\u00e8res REP : <strong>\u201cfinanci\u00e8res\u201d<\/strong> OU <strong>\u201cop\u00e9rationnelles\u201d<\/strong>.<\/p>\n<ul>\n<li><strong>Les REP financi\u00e8res <\/strong>: les collectivit\u00e9s collectent les d\u00e9chets aupr\u00e8s des m\u00e9nages, les traitent et per\u00e7oivent des \u00ab soutiens \u00bb de la fili\u00e8re REP en contrepartie. Par exemple : la fili\u00e8re des papiers graphiques et emballages <em>(gestion op\u00e9rationnelle des d\u00e9chets d\u00e9l\u00e9gu\u00e9e aux collectivit\u00e9s territoriales pour la collecte et le tri)<\/em>.<\/li>\n<\/ul>\n<ul>\n<li><strong>Les REP op\u00e9rationnelles<\/strong> : les collectivit\u00e9s acceptent, souvent en d\u00e9chetteries, les d\u00e9chets de la fili\u00e8re en question, par exemple les d\u00e9chets d\u2019\u00e9quipements \u00e9lectriques et \u00e9lectroniques, mais ce sont les producteurs qui organisent eux-m\u00eames la logistique, le r\u00e9emploi ou la r\u00e9utilisation, le d\u00e9mant\u00e8lement, la d\u00e9pollution, le recyclage et le traitement final.<\/li>\n<\/ul>\n<p>La <strong>Loi AGEC<\/strong> a pr\u00e9cis\u00e9 les obligations des \u00e9co-organismes, parmi elle une nouvelle : l\u2019obligation pour les \u00e9co-organismes de prendre en charge <strong>l\u2019enl\u00e8vement<\/strong> et le <strong>nettoyage<\/strong> des <strong>d\u00e9chets<\/strong> en cas de <strong>d\u00e9p\u00f4ts sauvages<\/strong>. Sur ce point, le d\u00e9cret limite cette obligation de prise en charge par les \u00e9co-organismes au cas o\u00f9 les d\u00e9chets concernent des produits relevant de leur agr\u00e9ment, et lorsque ces d\u00e9p\u00f4ts atteignent respectivement 100 kilos pour les d\u00e9chets dangereux, et une tonne pour les d\u00e9chets non dangereux ou inertes.<\/p><p><br><\/p>\n<p><\/p>\n<h2>Le suivi et le contr\u00f4le des fili\u00e8res REP<\/h2>\n<p>En terme de contr\u00f4le, la <strong>loi anti-gaspillage<\/strong> pr\u00e9voit que les \u00e9co-organismes et les syst\u00e8mes individuels doivent se soumettre \u00e0 \u201c<i>un <strong>auto-contr\u00f4le p\u00e9riodique<\/strong> reposant sur des <strong>audits<\/strong> ind\u00e9pendants r\u00e9guliers r\u00e9alis\u00e9s au moins tous les deux ans, permettant notamment d\u2019\u00e9valuer leur gestion financi\u00e8re, la qualit\u00e9 des donn\u00e9es recueillies et communiqu\u00e9es ainsi que la couverture des co\u00fbts de gestion des d\u00e9chets<\/i><i>\u201d<\/i>, dont la <strong>synth\u00e8se<\/strong> est rendue <span style=\"text-decoration: underline;\"><strong>publique<\/strong><\/span>.&nbsp;<\/p>\n<p><strong>Un contr\u00f4le est \u00e9galement effectu\u00e9 par l\u2019ADEME : <\/strong>la loi AGEC fixe le principe d\u2019une <strong>redevance<\/strong>, pay\u00e9e par les <strong>companies<\/strong> soumises \u00e0 REP et allou\u00e9e \u00e0 l\u2019ADEME pour lui permettre de financer de nouveaux postes, et d\u2019assurer les missions de suivi et de contr\u00f4le des fili\u00e8res.&nbsp;<\/p>\n<p>Les missions de suivi et d\u2019observation des fili\u00e8res REP,&nbsp; confi\u00e9e \u00e0 l\u2019ADEME comprennent <em>(<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/section_lc\/LEGITEXT000006074220\/LEGISCTA000006176686\/2020-11-30\">art. R131-26-1 \u00e0 R131-26-4<\/a>, du d\u00e9cret du 27 novembre 2020 suite \u00e0 la loi AGEC)&nbsp;<\/em>:<\/p>\n<ul>\n<li>La r\u00e9alisation des <strong>\u00e9tudes<\/strong> and <strong>\u00e9valuations<\/strong> pr\u00e9alables \u00e0 l\u2019agr\u00e9ment ou au renouv\u00e8lement d\u2019agr\u00e9ment des syst\u00e8mes individuels et \u00e9co-organismes ;<\/li>\n<li>La <strong>collecte<\/strong>, le <strong>traitement<\/strong> and <strong>l\u2019analyse<\/strong> des <strong>donn\u00e9es<\/strong> et informations permettant le suivi des fili\u00e8res ;<\/li>\n<li>La mise \u00e0 disposition du public, au moins chaque ann\u00e9e des informations sur les fili\u00e8res <em>(not. le niveau de r\u00e9alisation des objectifs de pr\u00e9vention et de gestion des d\u00e9chets, les quantit\u00e9s collect\u00e9es et trait\u00e9es, etc.)<\/em>.<\/li>\n<\/ul><div><br><\/div><div><br><\/div>\n<h2>Les sanctions en cas de non atteintes des objectifs<\/h2>\n<p>En cas de <strong>non-atteinte des&nbsp; objectifs<\/strong>, la loi AGEC&nbsp; pr\u00e9voit que l\u2019\u00e9co-organisme doit alors prendre des <strong>engagements<\/strong> et leur allouer un montant financier correspondant \u201c<i>au nombre de points d\u2019\u00e9cart par rapport \u00e0 l\u2019objectif fix\u00e9 multipli\u00e9 par le co\u00fbt moyen d\u2019un point d\u2019objectif atteint major\u00e9 d\u2019au moins 50 %<\/i>\u201d.
